EMERSON UPDATE

The Government appealed Judge Sam Cummings ruling in Emerson to The 5th Circuit Court of Appeals. The Fifth Circuit rejected Judge Cummings' opinion and then Emerson filed a Writ of Certioari before the Supreme Court. The Supreme Court rejected Emerson's writ and remanded the case to the lower courts for further proceeding.

Interestingly, in the 5th Circuit's opinion, they recognized that the right to keep and bear arms is an indivdual right.
